印尼突然扣留数十艘无辜船舶,不让正常离港!

  今天一条有关印尼因为国内税收的问题致使多达30~50条在印尼装煤船变相地被扣留而不能正常离港的消息在租船操作群里引起了广泛的讨论。消息称:

  This is to inform you that due to some sudden changes in Indonesian Government Policies, export procedures has been changed with immediate effect. Exports being previously cleared on trade license now has to be processed under Miners Licenses along with export duties. Even the same is immediately functional for the shipments already loaded and therefore, no ship can sail or load further unless export duties and mine license documentation been done and therefore, all cargo already loaded has to be unloaded back to jetty.

  All these has severely impacted the business in Indonesia, almost 20 - 25 shipments are now held at East Kalimantan and 10 -15 at South Kalimantan. We regret to inform you this but as implies, many shipments are stuck in these changed policies with uncertain consequent hereafter. (As per letter from Ministry of Finance Republic Indonesian narrating same.)
  


  Exports blocked in Samarinda amid clampdown on unpaid tax

  Exports from several miners in Samarinda, East Kalimantan have been blocked by local authorities amid a clampdown on those who have outstanding tax payments to meet.

  Officials have stopped issuing survey reports (LS) and the notifications of exported goods (PEB) mandatory for coal exports to miners with unpaid tax bills, it is understood.

  All of the affected miners are said to be IUP (Business Mining License) holders, which are generally smaller miners than those that hold Indonesia's other coal mining permit, Coal Contract of Work (CCoW).

  The clampdown is understood to be coming from the Corruption Eradication Commission (KPK), which has in recent years put pressure on local authorities to ensure illegally mined coal is not exported.

  In 2012 and 2013, Indonesia exported 56 mt and 74 mt respectively of coal from non-compliant miners, categorised as illegal.Since then authorities, have stepped up measures to stem the revenue losses arising from this.

  This latest crackdown has slowed the processing of paperwork for all miners in the region.

  It is as yet unclear how much tonnage has been prevented from loading. There are also unconfirmed reports of miners in South Kalimantan being affected too.

  IHS Markit Maritime data show that 47 vessels were queued in Samarinda as of 2 July, significantly higher than the 32 vessels seen on 25 June, when it was last tracked.

  据了解,此次事件产生的原因:

  印尼发货人委托的出口代理商因为自身过往生意的税务问题被政府税务部门调查,印尼海关应政府要求冻结了出口代理商的出口许可证,导致相关船舶货物无法取得出口许可从而导致船舶无法正常离港。

  发货人拥有在印尼进行矿物产贸易的证书,即IUP (Business Mining License) holders,但是没有出口许可证,因此发货人委托其他拥有出口许可证书 ( Export Permit Licence Holder)的公司作为他们的出口代理商,作为名义发货人来出口动力煤。

  但是因为出口代理商过往出口货物项下缴纳的税存在争议,突然就被印尼海关查封冻结。

  据悉,现在发货人愿意完全按照印尼政府的规定就相关船舶缴纳相应税费,但是海关系统还是不允许相关正常离港, 而且印尼海关系统也不允许发货人更改其它合格的出口代理商进行出口。

  现在,出口代理商本身税务问题何时能查清目前完全没有确切时间表。如若没有其它方式解决,相关船舶将被滞留无法预估的更长时间。

  据悉,目前已有船舶在Taboneo被滞留一个月之久,且没有任何可以正常离港的迹象。

  相关船舶如果长期被滞留,将产生严重后果:

  动力煤炭为易燃易爆货物,长期留存船上对船舶,船上船员人生安全是个极大的危险。

  船上正常淡水,物资,食物和燃料油的供给已经开始告急,严重危害船员安全。

  船东、OP公司及国内收货电厂将产生重大经济损失。

  专家建议:

  相关船舶上的货物本身并不存在问题,货物并没有偷税漏税。即使出口代理商之前存在问题需要查究,印尼海关也不应该殃及无辜,长期滞留无过错船舶,使无辜方承受巨大的经济损失。

  建议,印尼有关方面允许印尼发货人更换其他合格的出口代理商为其尽快办理出口许可事宜,让相关船舶尽快开航离港.

  事实证明,印尼在某些地方真的是一个非常搞笑的国家,政策朝令夕改再添一实例!

  2017年10月31日,为了促进本国航运业发展,增强本国航运业在自身外贸出口市场的影响力,印度尼西亚贸易部发布最新法规,要求印尼煤炭及棕榈油出口商在出口货物时必须使用印尼船旗的船舶并投保印尼本国保险公司。

  新的法规在发布后6个月后生效。新法规的发布在印尼国内外贸易商,以及航运业内引起了一场小小的恐慌”。

  但是,印尼船旗的5万吨左右的干散货船舶用几只手都能数过来,并不能保证煤炭的出口运输需求。

  然后,推迟!

  随后在今年4月4日,信德海事网报道,印尼工业部长(Industry Minister )Airlangga Hartarto表示,为了增加出口,进而增长外汇储备,印尼将推迟该法规的执行日期至2020年。Airlangga告诉记者,“该法规的执行时间点将被调整,我们将给航运业2年的特殊过渡期。”

  一变再变,最终取消!!

  印尼政府最终取消了这项有争议的煤炭限制运输计划。
  


  根据最新消息,印尼政府最终废除了这项禁止外国(非印尼船旗的船舶)运输本国出口煤炭棕榈油以及大米的法规!印尼贸易部长Enggartiasto Lukita 向媒体最终了确认了废除本项规定的消息。
